When the Mexican drug cartels can't even sustain operations due to a lack of labor because all of their hired thug help has crossed the border into America....well, doesn't that basically substantiate everything Donald Trump has said?

Analyst: Mexican Cartel Openly Advertising for Members Because of Exodus of Young Males to U.S.

(CNSNews.com) – A Mexican drug cartel’s brazen decision to use street flyers to recruit new members in central Mexico may in part be the result of a local labor pool decimated by young men who leave the country to look for work in the U.S., according to one analyst.

The cartel, according to security specialist and national university professor Raul Guillermo Benitez Manaut, may be having trouble finding new help because of a lack of young men living in the area where the cartel operates, namely northern Michoacán, northern Guanajuato and southern Jalisco. Seventy-percent of the local population is female, he said.

Benitez called the use of flyers a “desperate” measure not seen before – and “very risky” for the gang because it allowed for government infiltration.

It is also a sign that the cartel, known as the New Generation, is expanding in the southwestern state of Jalisco to fill a vacuum left by the government’s successful anti-cartel activity in the neighboring state of Michoacán, he said.

The recruitment flyers offered work as guards and bodyguards with a fictitious security firm, but respondents were sent instead for arms training and then inducted into the cartel, the Associated Press reported earlier.

Jesus Eduardo Almaguer Remirez, the chief prosecutor in Jalisco, said approximately a dozen recruits were arrested earlier this month, including an American woman who reportedly headed up the effort to hand out flyers in the beach resort of Puerto Vallarta.

Alejandro Hope, a security analyst in Mexico City, said the use of the flyers showed how willing the cartel was to act in the open without fear of prosecution.

Mexican drug cartels strictly rely on word of mouth to attract new members, Benitez said. Recruitment is never done in the open as it’s seen as too risky. “They normally recruit using family members, to be safer,” he said.

"Normally it is done through friends or acquaintances. Now they are doing it openly, deceiving people, obviously, but openly."

Media reports said the government was tipped off to the flyer recruitment effort when one recruit’s family complained he had been kidnapped and held for ransom after refusing to work for the cartel. At a press conference, Almaguer Remirez also referred to the cartel’s difficulties attracting new members and said it was increasingly using threats and coercion.

A study of Mexican migration to the U.S., commissioned by the national Congress, found the greatest outflow of workers between 2005 and 2010 was from the central state of Guanajuato (182,960), followed by Michoacán (153,570) and then Jalisco (151,260).

One-third of all Mexicans who went to the U.S. during the period were from the central part of the country and totaled just over 576,000, the study found.

Benitez said efforts by the New Generation cartel to recruit former employees of two other cartels hit hard by government actions in Michoacán also appear not to be working.

Former members of the cartel once headed up by Joaquín Archivaldo Guzmán Loera – the infamous drug lord recently recaptured by authorities – may fear being killed if they sign up with a new cartel, Benitez said.

Meanwhile, the Mexico City daily El Universal reported Sunday that Mexican authorities made 2,982 arrests from 2006 to 2015 for the illicit use of exact copies of police and security force uniforms, as well as the cloning of security vehicles. Benitez said drug cartels often use the cloned cars and uniforms to move contraband unimpeded.

So far, the cartels haven’t turned to the Internet to recruit employees, he said. Use of the Internet by the cartels is almost unheard – except for Twitter, which has been used by cartels in in Nuevo Laredo and northern Tamaulipas to threaten people and for extortion, but not to recruit new members, Benitez said.

Obamacare For Illegal Aliens? It Was Inevitable

The Inevitability of Obamacare for Illegal Aliens


You knew it was coming. I knew it was coming. When government expands entitlements, illegal aliens always end up with a piece of the pie. Obamacare promoters relented to GOP pressure to include an illegal alien ban on eligibility and vowed endlessly that no benefits would go to the "undocumented." But denial isn't just a river in Egypt. It's the Obama way.

In Oregon this week, officials confessed that nearly 4,000 illegal immigrants had been "accidentally" steered from the state's low-income Medicaid program and instead were enrolled in Obamacare in violation of the law. Oopsie. The Oregonian newspaper's Nick Budnick reported that the health bureaucrats "discovered the problem several weeks ago and are correcting it." Get in line. The beleaguered Cover Oregon health insurance exchange has been riddled with ongoing problems, errors and glitches since last October that have yet to be fixed.

Take note: This wasn't a one-time computer meltdown. Because Oregon's health insurance exchange website has been offline and its software architects under investigation for possible fraud, the Oregon Obamacare drones have been processing each and every application manually. That means nearly 4,000 illegal alien applications with "inaccurate" data somehow passed through government hands and somehow ended up getting routed through as new enrollees with Obamacare-approved full-service health care.

How many Obamacare services did these nearly 4,000 illegal aliens avail themselves of, and at what cost?

Does anyone believe the same incompetent boobs who enrolled them will be able to track down the nearly 4,000 illegal alien beneficiaries, "correct" the "errors" and ensure that it doesn't happen again?

What a slap in the face to the millions of law-abiding Americans who have lost their health care coverage and work hours thanks to Democratic-sponsored federal health care regulatory burdens and mandate costs.

One Oregon Obamacare manager defended the unlawful illegal alien enrollment by explaining: "We were just getting people into the services." And there's the rub. The imperative of these government social engineers is to herd as many "clients" into taxpayer-subsidized programs as possible. Just last week, Obama's Homeland Security Secretary Jeh Johnson publicized an open letter to families with illegal alien relatives promising that no one would be deported for seeking Obamacare services.

"No one in America who is eligible should be afraid to apply for health coverage because they have a family with mixed status," Johnson assured. And in another sign of how the White House is still planning for mass illegal alien amnesty, Johnson also made clear: "Enrolling in health coverage ... will not prevent your loved ones who are undocumented from getting a green card in the future or who do not yet have a green card at risk."

As always, California Democrats are at the forefront of busting open Obamacare for the illegal alien population. Earlier this month, Democratic state Sen. Ricardo Lara introduced a bill to extend health benefits and a special online marketplace to one million illegals under an Obamacare-style program subsidized by state taxpayer dollars.

In case you forgot, President Obama had already paved the path for illegal alien Obamacare when he signed the massive expansion of the State Children's Health Insurance Program (S-CHIP) in 2009. As I've reported previously, the law loosened eligibility requirements for legal immigrants and their children by watering down document and evidentiary standards -- making it easy for individuals to use fake Social Security cards to apply for benefits with little to no chance of getting caught. In addition, Obama's S-CHIP expansion revoked Medicaid application time limits that were part of the 1996 welfare reform law.

Open-borders activists saw those provisions as first steps toward universal health coverage for illegals. They see America as the medical welcome mat to the world. Over the past year, they've ratcheted up public protests demanding free organ transplants for illegal alien patients. In Chicago last fall, they marched on a hospital with caskets and posters demanding scarce organs. One illegal alien blasted authorities for putting "paper over our lives." In California, illegal alien transplant patients count on federal incompetence and lax enforcement to abet them, because if they notify the state that DHS "is aware of their presence and does not plan to deport them," they are eligible for full-blown Medi-Cal coverage, according to the state.

Now, Obamacare peddlers from Oregon to New York and all points in between are rushing to sign up new "customers" in advance of the March 31 open enrollment deadline. How many more thousands of illegal aliens will be roped into the system? Remember: In the lexicon of the left, "accidental" is just another word for inevitable entitlement creep.

Democrats in Congress are enthusiastic about the new "Affordable Citizenship Act" which President Obama introduced by Executive Order at midnight on New Year's Eve. All existing citizens of the U.S. except those who work for the government will soon have received letters in the mail informing them that their current citizenship has been cancelled. This is due to the exciting new grandfathering clauses in the new Act which are designed to improve the U.S. citizenship experience for all human beings throughout the world.

Automatic Re-Granting of Citizenships

As President Obama will explain in a forthcoming TV address, persons who have lost their citizenships can simply reapply for one of the new and better citizenships on offer at the broken.gov website and at the Acorn Citizenship Fairness Offices (ACFOs) which have been set up in DMV locations throughout the country.

The new Act replaces the existing system with three new levels of citizenship, Platinum, Green and Gold.

Platinum Level: Exciting Opportunities at No Cost

Government employees and their friends and relatives automatically receive the Platinum Level of Citizenship.

Green Level "Obamacard": Automatically Available to All Existing Citizens At Maximum Convenience

Citizens not working for the government will be eligible to apply for the exciting new Green Card, also called the "Obamacard," in honor of our President's grand new vision for the transformation of our country. To obtain their Green Card they will be required to pay a one-time fee of only $1,000, plus an annual deductible of $5,000 per family member, to be paid in advance on January 1 each year. The annual deductible is set aside to cover all normal administrative costs of processing Green Card applications by the ACFOs. Additional out of pocket costs to cover entertainment and hotel expenses for administrators of the program are not anticipated to be more than $10,000 in any given year per family member, also payable in advance on January 1 each year. Obama Meets In Oval Office With Illegal Aliens

President Barack Obama and Vice President Joe Biden met in the Oval Office on Tuesday with three people who are in the country in violation of U.S. immigration laws but who have received "deferred action" allowing them to stay in the country under the terms of a "memorandum" issued unilaterally last year by Homeland Security Secretary Janet Napolitano.

While conceding that she had no legal authority to change the "immigration status" of illegal aliens or provide them with a "pathway to citizenship," Napolitano instructed the top officials at Customs and Border Protection, Citizenship and Immigration Services, and Immigration and Customs Enforcement to use what she called "prosecutorial discretion" in not enforcing the immigration laws against certain classes of immigration lawbreakers.

These included illegal aliens who arrived in the United States before their sixteenth birthday, had graduated from high school or served in the military, had not been convicted of "significant" or "multiple" misdemeanors, and had not yet turned thirty.

Before Napolitano issued this unilateral order allowing the illegal aliens to remain in the country in violation of the law, President Obama's allies in Congress had failed to secure passage of the Dream Act, which would have allowed such persons to became legal residents in the United States.

In all, Obama and Biden met on Tuesday with eight people who are advocating immigration reform, according to White House readout of the meeting. The White House readout listed three of those as having received "deferred action." Most others were legally in the United States with relatives who were illegal aliens.

A White House blog entry on the meeting included an official White House photograph of it that carried a caption describing some of the attendees as people "who have received Deferred Action and U.S. citizen family members of undocumented immigrants."

“At the meeting, the president reiterated his commitment to passing a bipartisan, commonsense immigration reform bill this year,” said the White House readout of the meeting. “He made clear that while the current bill is not perfect, it does represent an important step towards the broad principles that need to be part of any immigration reform package.”

On Tuesday, the Senate Judiciary Committee sent an immigration bill to the full Senate. It includes what its supporters call a “pathway to citizenship,” and what its opponents call “amnesty.”
“The President and the Vice President thanked participants for their leadership, courage and on-going efforts to move immigration reform legislation forward,” said the White House statement about the president's Tuesday meeting.

“The Dreamers shared how their lives have been positively affected by the deferred action process and emphasized that they and their families need a permanent solution that will allow them to fully contribute to the country they call home.”

The White House listed the following people as having participated:

- “Angie Kim. Angie is a South Korean immigrant who resides in New York, New York; she received deferred action.”

- “Kevin Lee. Kevin is a South Korean immigrant who received deferred action. He currently resides in Los Angeles, California. Both of his parents are undocumented.”

- “Justino Mora. Justino received deferred action; he currently resides in Los Angeles, California.”

- “Diana Colin. Diana is a legal permanent resident who currently resides in Los Angeles, California. One of her brothers received deferred action.”

- “Kate Kahan, Legislative Director, Center for Community Change. Kate is the Legislative Director for the Center for Community Change, a national social justice organization that is a member of the Alliance for Citizenship coalition in support of commonsense immigration reform.”

- “Miguel Leal. Miguel is a U.S. citizen who resides in Fitchburg, Massachusetts. He is an Iraq war veteran. Miguel is an immigrant from Cuba; his wife in undocumented.”

- “Mehdi Mahraoui. Mehdi came to the United States from Morocco when he was 7 years old. He is a legal permanent resident and lives in New York, New York. His parents and his older sister remain undocumented.”

- “Melissa McGuire-Maniau. Melissa’s husband is an undocumented immigrant from Mexico. Melissa is a U.S. veteran; she and her husband reside in Winter Park, Florida.”

Bob Dane, spokesman for the Federation of Americans for Immigration Reform, said this shows disrespect for the law from the president who swore to uphold the laws of the United States.

"It’s staged to reinforce the one message that for this president is unambiguous – violating immigration laws now, in and of themselves, is just entirely inconsequential," Dane told CNSNews.com.

"The laws will not be enforced, and the public just needs to get used to it. Illegal aliens are here. They’re proud. They’re not going anywhere, and they can sit and stand anywhere they want, including the United States Capitol and the White House, and this president will bend the laws to suit their circumstances, and his political needs, with no regard whatsoever for American workers and taxpayers," he added.

How Long? How Damn Long Is This BS Line About Not Being Able To Find and Deport Illegals Going To Fly?

I'm pissed off.

This morning I was watching Fox News Sunday (I know, I'm a sucker for punishment) and Senator Marco Rubio was on to talk about the Immigration Reform Bill that has been worked out by the Gang of Eight.  During that interview, Rubio pulled out the tired old line from the Left that we simply don't have an option to find and deport 11 million illegal aliens from this country.

So, I ask the question...have you heard a SINGLE politician on the Left in this country EVER say that there is NO WAY that we could EVER confiscate every legal firearm in this country?  We can find 250 million guns in this country but we can't find 11 million illegal aliens?  We can find 50 million people who end up not paying for Obamacare but we can't find 11 million illegal aliens?

Let me see...the Nazis in Germany and Poland seemed to be able to round up over 6 million Jews in a relatively short time but hey, we can't round up 11 million illegal aliens in America some 70 years later.

By the way, in case anyone missed the Fox News Sunday broadcast earlier, Senator Dick Durbin was on to assure all of us that the U.S.-Mexico border has NEVER been more secure.

Senator Rubio’s Immigration Enforcement Fantasy


The silly season is upon us again, which is to say: Washington finds itself in yet another debate over "comprehensive immigration reform."

The core silliness could be heard in the arguments of Marco Rubio, one of four Republicans in the Senate "Gang of Eight" urging a deal that purports to ensure real immigration enforcement in exchange for legalization of status and an ultimate "path to citizenship" for millions of illegal immigrants. Earlier this afternoon, Sen. Rubio was interviewed by Rush Limbaugh.

Sen. Rubio admirably insisted, "We need border security. We need workplace enforcement. We need a visa tracking system." But, as Rush pointed out, President Obama is outlining his own vision of immigration reform in Las Vegas today, and it promises to diverge in a fundamental way from the Gang of Eight proposal: The president has no interest in immigration enforcement. He wants only the legalization goodies for current illegals and the incentives they'll inevitably create for more illegal immigration. He is not interested in the protections for the American people that Sen. Rubio touts.

Sen. Rubio confidently responded that if the president makes such a pitch, he will have a huge problem with his own party - in particular, with Sen. Chuck Schumer and the other Gang of Eight Democrats who've supposedly committed their party to meaningful enforcement measures. This contention is absurd. It suggests that Sen. Rubio either does not understand how the federal government works (highly unlikely for a man of Rubio's obvious intelligence), or is making a monumental miscalculation - elevating over the certain-to-be-damaging consequences of his proposal the futile hope that Republicans will win lasting accolades from the pro-illegal immigration Obamedia.

The executive branch is in charge of law enforcement, period. Congress cannot enforce the law and cannot compel the president to do so. And we already know there will be no meaningful immigration enforcement as long as President Obama is running the executive branch. As usual in Washington's progressive crusades, we are expected to forget all relevant history - in this instance, not only the sorry history of the 1986 amnesty (in which Washington predictably provided all the legalization goodies but reneged on the enforcement promises) but also the Obama administration's more recent, more virulent anti-enforcement record.

Can Sen. Rubio have missed the Obama Justice Department's lawsuit against the citizens of Arizona? The state enacted a law that simply reaffirmed the Congress's own immigration statutes and enabled state police to enforce those federal standards. The Obama administration not only sued the state for enforcing federal law, it did so by positing a radical new understanding of the "pre-emption" doctrine. Formerly, that doctrine stood for the proposition that the states could not enact laws that contradicted properly enacted federal statutes. Under Obama's interpretation, the states were precluded from enacting laws that contradicted U.S. executive branch enforcement policy even if they were completely consistent U.S. congressional law.

Thus, according to Obama, if the president's policy is to refrain from enforcing Congress's statutes, sovereign states may not enforce them either, even if such non-feasance renders the states defenseless against the tide of illegal immigration overrunning their borders and budgets. It matters not, in this radical view, that self-defense is a basic aspect of sovereignty or that, if the Obama preemption theory had been evident in the Constitution, there would be no United States because the states would never have ratified it.

That is how committed Pres. Obama is to non-enforcement. Consequently, it is the height of foolishness for Sen. Rubio to talk about fissures between the administration and Congressional Democrats on enforcement measures. Chuck Schumer has nothing to do with enforcing the immigration laws. Even if he and his colleagues were serious about enforcement - and, as Mark Krikorian and Mickey Kaus explain, the enforcement promises in the Gang of Eight proposal are patently fraudulent - their earnestness would be irrelevant. Obama has not only posited but argued in the Supreme Court that federal statutes are trivial; the only thing that matters is raw executive power: his unfettered discretion in choosing to enforce or not enforce the law.

That being the case, what is the point of the Gang of Eight exercise? The Republicans pushing the deal tout its illusory enforcement measures, but even if these were real lawmakers are not in a position to compel the president to execute them. And think about it: it is precisely because the law is not being enforced in the first place that the senators perceive the need to promise law enforcement as a premise for the windfall illegal aliens would get from the Gang of Eight proposal. If the laws already on the books are not being enforced, why on earth would anyone think a new law would make a bit of difference - particularly when it would be equally impotent in the matter of forcing Obama's hand?

In the end, that really is the point. It makes no sense to write a legislative proposal that confers unwarranted benefits on the condition of stepped up law enforcement. If the Republican senators are serious, they should just call for enforcement of already enacted laws. They should tell Democrats, "Show us over the next few years that enforcement is effective and that the government's commitment to it is permanent; then we can talk about legislation to legalize the presence of the remaining illegal immigrant population." The way you prioritize enforcement is ... to prioritize enforcement, not to talk about enforcement you can't deliver in a wayward deal that concretely rewards lawlessness. And in the meantime, if it would help our economy to allow more immigration of workers to fill needs that aren't being met, by all means increase the availability of visas for those categories of workers - as dramatically as necessary. This will illustrate that Republicans are not anti-immigrant - the "false argument" that animates Sen. Rubio, as he told Rush. It is a slander that sticks because of the GOP's inadequate response to the Left's demagoguery, not because of bad policies.

I take Sen. Rubio at his word that he wants immigration laws enforced and thinks enforcement is the foundation of a humane immigration policy (even though I vigorously disagree with his contention that the Gang of Eight proposal makes real enforcement a condition of valuable benefits). But it is impossible to take seriously any proposal that entrusts enforcement to President Obama. If you're serious about enforcement, you can take no other position than that any consideration of making legal-status concessions to illegal immigrants must await a new president who can be trusted to honor his oath to take care that the laws be faithfully executed.

Finally, I note that nothing I've argued here alters my previously stated position that immigration enforcement should primarily be a state responsibility. I do not understand how Republicans can purport to be "Constitutional conservatives" and skip past the inconvenient fact that the Constitution empowers Congress only to set the qualifications of citizenship, not to police immigration. The framers intended immigration enforcement to be among the plethora of internal matters be handled by the states - with the federal government obliged to assist states in the event they were threatened with being overrun by trespassers.

I believe that returning immigration enforcement to the states would result in the most sensible and humane immigration policy. States that wished to be sanctuaries for non-citizens would be able to do that, provided they were willing to pay for the attendant largesse themselves. States that preferred vigorous enforcement could follow that policy. States would set their enforcement and social-welfare policies in accordance with their economic conditions. Aliens would gravitate to hospitable areas and avoid places where they were not welcome. There would be no centralized, one-size-fits-all policy but different standards based on local conditions fashioned by the citizens who were most effected - and easily changed if conditions changed.

Unfortunately, Washington and the federal courts decided, a century-plus into our constitutional history, that we had somehow evolved beyond that framework. The states and most conservatives have gone along for the ride. Thus we continue the folly of favoring a single, universal policy that is based on the hope for law-enforcement by a president who is both committed to non-enforcement and apathetic when it comes to the very different hardships that beset different states.

Hezbollah and Iran Have Seeded the U.S. With Hundreds of Operatives


Read that title again....and if that doesn't make you shiver, I don't know what will. The article comes to us from Family Security Matters and speaks to some investigations here in America that have yielded proof of this infiltration of America by operatives from Hezbollah and others directly from Iran.

As tensions escalate over Iran's nuclear weapons program, the committee met Wednesday to assess the possibility of Iranian/Hizballah attacks in the United States in retaliation for sanctions or a possible military strike. Last fall's unraveling of an Iranian plot to assassinate Saudi Arabia's ambassador to Washington showed that Iranian leaders "now more willing to conduct an attack in the United States in response to real or perceived US actions that threaten the regime," Director of National Intelligence James Clapper told a Senate panel in January.
Suspect Manssor Arbabsiar told investigators that "he was recruited, funded and directed by men he understood to be senior officials in Iran's Qods Force."

And so we now see the real price that America will pay for this lax attitude we've had regarding the security of our southern border...we saw evidence of Hezbollah coming across our border with Mexico nearly 2 years ago and yet, not a single thing was done to try beef up the security of our country from these types of terror elements. So now they are here. And as you read this, they are busy plotting.




Hizballah, Iran Have Hundreds in the U.S.


Iran and its Lebanese proxy Hizballah have seeded the United States with hundreds of operatives, some of whom are capable "of flipping a U.S.-based fundraising cell into a lethal terror force, should Iran decide that is in its interests," a preliminary report from the House Homeland Security Committee finds.
As tensions escalate over Iran's nuclear weapons program, the committee met Wednesday to assess the possibility of Iranian/Hizballah attacks in the United States in retaliation for sanctions or a possible military strike. Last fall's unraveling of an Iranian plot to assassinate Saudi Arabia's ambassador to Washington showed that Iranian leaders "now more willing to conduct an attack in the United States in response to real or perceived US actions that threaten the regime," Director of National Intelligence James Clapper told a Senate panel in January.
Suspect Manssor Arbabsiar told investigators that "he was recruited, funded and directed by men he understood to be senior officials in Iran's Qods Force."
New York presents a top target in any future plot, NYPD Director of Intelligence Analysis Mitchell Silber told the committee. Between 2002 and 2010, NYPD and federal officials identified at least six cases in which Iranian diplomats were caught conducting "hostile reconnaissance of New York City," he testified. In one case, people carrying credentials from the Islamic Republic of Iran Broadcasting Company ignored incoming and outgoing flights, photographing and videotaping the landing pad and waterline at the Wall Street Heliport.
Other witnesses described the kinds of criminal activity in the United States linked to Iran and Hizballah. Chief among them was a massive cigarette smuggling ring based out of North Carolina that sent profits back to Hizballah leaders in Lebanon. Many of the suspects had military training from Hizballah, said former Chris Swecker, who served as Assistant Director of the FBI's Criminal Division and who worked on the case.
That profile matches what the NYPD sees in some ongoing investigations, Silber said.
The hearing had nothing to do with the debate over how to best address Iran's nuclear program. But the committee's ranking Democrat, Bennie Thompson of Mississippi, devoted nearly his entire opening statement to that issue, noting the United States did not attack Iran in response to the 1979 hostage crisis or after determining Iran was complicit in various terrorist attacks on American targets. In addition, the Democrats' witness at the hearing, former Deputy Assistant Secretary of Defense Colin Kahl, focused his prepared remarks on the nuclear issue.
When Thompson indirectly addressed the security issue, he urged law enforcement not to look at any particular moment in time and pretend it tells the whole story.
That drew a rebuke from Republican Dan Lundgren of California. The 9/11 Commission chastised government for failing to connect the dots leading up to the al-Qaida attacks in New York and Washington, he said. "Aren't dots snapshots in time?"
The dots currently in sight, from the plot to kill the Saudi ambassador to attempted terrorist attacks in the past six weeks traced to Iran in Thailand, India and Georgia indicate "we may be moving toward a point ..[of] a higher likelihood of terrorist activity in the homeland," Silber said.

Why Is the Obama Administration Lying To the American People About Deportation of Illegal Immigrants?


Welcome to Obama 101. You see, ever since the American people took a dumb pill and elected the leftist Senator from Illinois to the Presidency, we have seen Barack Hussein Obama employ one common tactic - lie to the American people and then rely on the socialist media propaganda machine in this country to ignore it and/or cover it up.

The latest example of another Obama lie, another Obama deception is the reporting of deportations of illegal immigrants.

"In other words, the Obama administration is cooking the books to make it look like they are enforcing immigration laws, when in reality they are enacting amnesty through inaction," he stated.

Under the Obama administration, worksite enforcement has dropped 70%, making it easier for illegal immigrants to live and work in the U.S. And DHS recently established a working group with the specific purpose of overruling or preventing orders of removal for illegal immigrants.


This is just yet another example of the snake oil salesmanship of our President - like a snake oil salesman who puts an actor up in front of the crowd to show the "miraculous" effects of his worthless snake oil medicine, Barack Hussein Obama has his front men put out statistics to show he is deporting more and more illegals yet he is doing the opposite...he is embracing undocumented immigration to this country.

Yep, we've also seen this technique as the President puts his wife out in front of the cameras with her work with military families while Obama continues to put our troops in harm's way and they laugh in secret over their despising of anything military.

This President is a liar. He has lied about his feelings about America. He has lied about Fast and Furious. He has lied about his religious faith. He has lied about his college education. He has lied about his whole life. He has lied for over 1000 days to the American people and for his approval to be above 15% is beyond me.




Bogus Deportation Statistics Released by Obama, Say Lawmakers


President Barack Obama's Homeland Security Department officials released a report that claims Immigration and Customs Enforcement deported a record number of illegal immigrants in the last fiscal year, including an "unprecedented number of convicted illegals with criminal records."

However, a closer look at the figures reveals the report is bogus, according to the lawmaker in-charge of immigration oversight.

In the 2011 fiscal year which ended last month, ICE officials claim they deported more than 396,000 illegal immigrants nationwide -- the largest number in the agency's history, ICE officials said in a statement released yesterday. Of these, nearly 55 percent or more than 216,000 of the people deported were convicted of felonies or misdemeanors -- an 89 percent increase since FY 2008 when George W. Bush was president.

"Smart and effective immigration enforcement relies on setting priorities for removal and executing on those priorities," said ICE Director John Morton in a press statement.

However, there are some who claim the figures released by Morton -- who was the recipient of a unanimous "vote of no confidence" by his own staff, the men and women who serve as ICE agents -- are purposely misleading or out-and-out bogus.

"Meanwhile, seven million illegal immigrants have jobs in the U.S. We could free up millions of jobs for citizens and legal immigrants if we simply enforced our immigration laws. The President’s policies just don’t add up. It’s time to elect a President that puts the American people first by enforcing our immigration laws,” Smith urged.

"All one needs to do is compare the press releases issued by ICE during the Obama years and the Bush years to see they are not focusing on enforcing the nation's immigration laws these days," a Border Patrol agent told this writer.

"During the Bush administration, the majority of press releases highlighted the capture of illegal aliens working at companies across the nation. They even nabbed illegal aliens working at high-security facilities run by the U.S. government. Today, the majority of the press releases are issued with regard to child pornography, counterfeit designer clothing and accessories, and even drug arrests," said the source, who demanded anonymity.

U.S. Humanitarian Group Gives GPS Beacons To Illegal Alien Smugglers In Case They Need Help While Invading Our Country


I'm just not sure if the term "sheep" or "fence posts" is the best way to describe the stupidity of some of the American population but both would probably work in regards to a U.S. humanitarian group named Humane Borders who admits that they gave emergency GPS beacons to a Mexican group to hand out to "coyotes" who run illegal aliens across the U.S. border.

Here's the bleeding heart mentality....you see, if the smugglers (coyotes) get in trouble out in the desert in the middle of the night, they can use the GPS beacon to summon help! You know, it's kind of like giving a bank robber who is going to blow up the safe in a bank a couple of protective face shields and body armor...or let's see....giving a rapist who goes out at midnight an infrared scope so he doesn't step in a hole while he stalks his prey in a park.

For the love of pete. Just when you think you've heard it all.

"Migrants are getting into greater danger as they go further out across the border to avoid detection, and they need help," Hoover told Reuters in a telephone interview.


I wonder what is next for this group....hey, I have an idea...why don't they give a bunch of the same GPS beacons to the Somali muslim pirates so while they are out on the seas trying to capture a freighter, they can sound the emergency alarm if the seas get too rough!

I got a better idea here....why don't the members of Humane Borders just set up a damn rest area out in the middle of the Arizona desert....complete with snow cones and water and porta potties...they could roll out some red carpet and even have a few La-Z-boys out there so the illegals can put their feet up. You know, come to think of it...if Humane Borders handed out some AK-47's to the coyotes it might be helpful if they run into real coyotes.

Okay, I've completely run out of sarcasm to waste on these fools.

Last year 249 border crossers perished in Arizona, according to a database compiled by the Arizona Daily Star newspaper, drawing on figures tallied by medical examiners in counties flanking the border.

The deaths have risen over the past decade as security has tightened along the border and coincide with a decline in the overall number of arrests made by the U.S. Border Patrol, suggesting that the journey has become more hazardous.

But a spokeswoman for the U.S. Border Patrol's Tucson sector warned that the devices would put immigrants at greater risk by giving them a "false sense of security right out in the desert."

"We are concerned that people can get themselves in a very precarious situation if they are relying on this device," said agent Colleen Agle. "Unfortunately there's no guarantee that it's going to work."

Agle added that smugglers are "very unscrupulous" and care about the "dollar in their pocket," not the safety of those they guide.

Hoover said the device, a McMurdo Fast Find Personal Location Beacon Model 210, has a five-year battery life. When activated it uses GPS technology to determine its location and sends an emergency signal to a National Oceanic and Atmospheric Administration satellite.

When a distress signal is received, local search and rescue personnel are notified.

Hoover said it was not clear if the devices had yet been given to coyotes guiding groups over the border.

Anglos' in Texas - It's Over for You!

"It's basically over for Anglos" in Texas. It's a terrible situation that you are in. I am worried," says Demographer, Steve Murdock said.

Two of every three Texas children are now non-Anglo and the trend line will become even more pronounced in the future, said Murdock, former U.S. Census Bureau director and now director of the Hobby Center for the Study of Texas at Rice University.

B y 2040, only 20 percent of the state's public school enrollment will be Anglo, he said. Last year, non-Hispanic white children made up 33.3 percent of the state's 4.8 million public school enrollment.

The state's future looks bleak assuming the current trend line does not change because education and income levels for Hispanics lag considerably behind Anglos, he said.

Unless the trend line changes, 30 percent of the state's labor force will not have even a high school diploma by 2040, he said. And the average household income will be about $6,500 lower than it was in 2000. That figure is not inflation adjusted so it will be worse than what it sounds.

The Hits From Hugo Chavez Keep Coming, Venezuela Funds American Organization That Aids Illegal Immigrant Flow

For the past two and a half years, Hugo Chavez has consistently flipped the bird at the United States and of course, he's paid no price for it. Well, the hits keep a coming from the Venezuela dictator as it is now revealed that Venezuela is helping to fund an American organization that is doing its best to keep the flow of illegal immigrants coming into America.

Evidence has surfaced of his intentions to ship Russian weapons to terrorist organizations such as Hezbollah and criminal drug cartels such as FARC, to facilitate terrorist acts against the United States, including blowing up pipelines carrying oil to the United States. He has also promised to ship both uranium to Iran to help Tehran make nuclear weapons material and oil to help break a possible refined petroleum products sanctions law now before the US Congress. How much of this is just talk and how much real? The laptop on which these Chávez plans were found was a real computer, owned by a real FARC senior commander. How much risk do we want to face?

Open borders with the world pose grave dangers to the United States. The San Diego Union described the chaos on our borders this way: “Every night, the understaffed and outnumbered Border Patrol engaged in a losing battle of cat-and-mouse with thousands of illegal immigrants being led by ruthless smugglers. ... San Ysidro residents locked themselves in at night as smugglers and immigrants traipsed through their yards. Caches of drugs were carried across the border by smugglers and the people they were leading. Hundreds of illegal immigrants lingered in the median strip of Interstate 5 waiting for rides northward. Immigrants running across freeways were hit and killed by motorists."

Casa de Maryland condemns those who advocate effective limits on immigration as racists, as does Chávez. It has threatened civil disobedience should the US Congress not approve amnesty. It publishes pamphlets that instruct people to refuse to cooperate with immigration and law enforcement officials.


So let me get this straight - the state of Maryland is giving to the same organization that Hugo Chavez is giving to? I'm sure it makes most American feel all warm and cozy to know that there is an organization like this set up to take such good care of illegal trespassers into our country...an organization that is set up to aid and assist those that sneak across our border in the middle of the night.

A USA Columnist visited the border to examine the prospects for a fence. She wrote: : “The carnage makes one wonder why environmental groups aren’t out lobbying for a sturdy border fence — instead of arguing against tougher border enforcement.”

But we not only have a problem at the border. The United States still has no reliable system for verifying that foreign visitors have left the country. Federal officials estimate that “40 percent of the…illegal immigrants in the United States came on legal visas and overstayed.”

At a recent community event in Maryland, a veteran Democrat legislator told me there was no problem in Casa de Maryland receiving funding from Chávez because "Venezuela is a model for Latin and Central American development". I thought she must have been kidding. Inflation in the country is over 30% and may reach twice that. Unemployment is skyrocketing. Chávez has so mismanaged the economy the country does not produce enough coffee for domestic consumption for the first time ever. The currency has dropped in value by over half as Chávez prints money wildly.

The Times Square bomber, or the Detroit underwear bomber, are just a couple of numerous examples of the latest example of the connection between lax immigration laws--or lax enforcement of the laws we already have-- and potential terrorism. In the case of the Times Square clown, it was a case of granting citizenship to someone from a known state sponsored terrorist hotbed (Pakistan) and apparently looking the other way when reviewing what appears to be a sham marriage. How much worse is it to give tax-exempt status to those who actively seek to leave unprotected our borders while supporting themselves with funds from terror supporting states?

Anchor Baby Legislation in House and Senate: States Move to Require Presidents Natural Born Status

Two U.S. senators are introducing legislation that will halt the enormous numbers of foreign mothers barely reaching U.S. soil before birthin’ their babies, packing up the birth certificate and scurrying back home to grab siblings, grandparents, aunts, uncles and cousins to brave their new world of living illegally in the U.S. with the golden anchor baby.

Senators Rand Paul (R-KY) and David Vitter (R-LA):
“For too long, our nation has seen an influx of illegal aliens entering our country at an escalating rate, and chain migration is a major contributor to this rapid increase – which is only compounded when the children of illegal aliens born in the U.S. are granted automatic citizenship,” Vitter said. “Closing this loophole will not prevent them from becoming citizens, but will ensure that they have to go through the same process as anyone else who wants to become an American citizen.”
Similar legislation failed in the 111th Congress. Rep. Steve King has introduced similar legislation in the House in the 112th Congress.

Another piece of legislation has been introduced into the Arizona State House of Representatives to require presidential candidates to prove their eligibility to run for the office of president in the U.S. The Arizona house already has 25 co-sponsors and needs only 31 votes to pass. In the Arizona Senate, only 16 votes are needed to become law.
The proposal, which also is being taken up in a number of other states, is highly specific and directly addresses the questions that have been raised by Barack Obama’s occupancy of the White House. 
It says: Within ten days after submittal of the names of the candidates, the national political party committee shall submit an affidavit of the presidential candidate in which the presidential candidate states the candidate’s citizenship and age and shall append to the affidavit documents that prove that the candidate is a natural born citizen, prove the candidate’s age and prove that the candidate meets the residency requirements for President of the United States as prescribed in article II, section 1, Constitution of the United States.

The Perversion of the DREAM Act


This article at Family Security Matters concerns the DREAM Act and not only does it detail just how offensive this bill should be to the American people, it speaks to how a bunch of Congress asshats who have BEEN VOTED OUT OF OFFICE are getting set to ram it down our throats.

The main point of this article that I'd like to point out is this:


Here is my way of providing clarity to this argument:

The difference between an immigrant and an illegal alien is comparable to the difference between a houseguest and a burglar!

Having just provided you with the artful use of deceptive language that has all but stricken the word "alien" from the immigration debate, we suddenly find that the desire by the advocates for open borders and massive amnesty programs for illegal aliens to conjure up the image of the "American Dream" that they are now, incredibly willing to use the term alien!

As I noted in a recent commentary, the DREAM Act is an acronym for:

Development, Relief and Education for Alien Minors Act.

The attempt to see in our nation's kindness, weakness, was so strong that they were even willing to use a term that they have been adamantly eschewing for decades- "Alien." This was obviously done to equate amnesty for millions of illegal aliens with the "American Dream," a dream I might add, that has become increasingly elusive for all too many of our citizens regardless of race, religion, ethnicity or other such factors!


Get that? ALIEN minors - it's right there in the name of the Act. ALIEN. As in an uninvited trespasser. A lawbreaker. A criminal. A felon. These are the people that Harry Reid and Dick Durbin and the rest of the Leftist lawmakers wish to reward for successfully crossing our border illegally and avoiding capture. They have beat the system of laws in America and thus they need to be rewarded for that. That is what the Democrats want - because it will eventually lead to another 10-15% voting block for them.

Disgusting. The Democrat lawmakers are simply unAmerican. They are traitors. They are not worthy to live in this country. I want trials for these asshats and deportations (that's for BOTH the lawmakers AND the aliens).



The DREAM Act v. The American Dream


I have, as I expect you know, written a number of commentaries and participated in a number of televised debates on the issue of what is expected to be the efforts of the "Lame Duck" session of Congress to ram the DREAM Act through the legislative process. I hate to be repetitive and I know that I have already written a few commentaries about my great concerns about the DREAM Act but this issue is so important that I feel compelled to write this commentary today.

There are members of Congress who are, at this very moment, moving at warp speed to make a last-ditch effort to enact this legislative betrayal and must hear from We the People today!

Before I make note of the ways that the open borders/pro-amnesty advocates in the administration and in the Congress are attempting to deceive and betray the citizens and lawful immigrants of our nation, I want you to consider just how much chutzpah the "leaders" in our government are demonstrating.

"Chutzpah," as you probably know, is a Yiddish term that can be translated to mean gall, nerve or other such term. However, chutzpah possesses a particular inherent definition that is, at least to me, incomparable! The traditional example of a person who demonstrates real chutzpah is the young man who kills both parents and then throws himself on the mercy of the court claiming he is an orphan!

The advocates in the Congress and in the administration who are now attempting to seize their last opportunity during the "Lame Duck" session of Congress are, in my judgment demonstrating a level of chutzpah that eclipses that young (orphaned) murderer!

There have been ever so many attempts by members of Congress to ram "Comprehensive Immigration Reform" down the throats of the citizens of our nation. I have testified at a number of Congressional hearings about these efforts.

Many of the members of Congress who would vote in favor of the DREAM Act have been voted out of office this past Election Day- they were fired!

Stop and consider this.

When the average American worker is fired, whether for cause or not, they are often notified about their firing on the day that they are terminated. Often management has a supervisor or perhaps even an armed guard escort the employee to his (her) desk to remove their personal effects and make certain that they do not take anything that is not theirs. They are generally immediately escorted off the company's premises to make certain that they don't do any damage or commit any sabotage in anger.

Now there are members of Congress who will not be coming back to work in January. They were sent packing by their fed up constituents and yet, they have not relinquished their power.

Lame Duck sessions are problematic for a number of reasons but it is the way that our system works. Certainly it would be appropriate for a Lame Duck session to clean up last minute spending bills and make certain that there is continuity in our government's operation- but to think that an administration and members of Congress would seize the opportunity to accomplish something that is as controversial as the DREAM Act when they know- indeed, because they know, that this flies in the face of those they were sworn to represent is a betrayal of the citizens of the United States on a galactic scale!

In July 2006 i was called to testify before the House Subcommittee on Immigration, Border Security and Claims on the issue of Comprehensive Immigration Reform. Here is a link to a video of a portion of that hearing at which I testified (my comments regarding my opposition to that legislative disaster back then are every bit as relevant today).

About three years ago I wrote an Op-Ed piece for the Washington Times entitled, Immigration bill a "No go."

The members of Congress who won re-election will be participating in the Lame Duck session and will possibly voting on the DREAM Act. They need to be reminded by their constituents that they will also face their own day of reckoning in just two short years in the House of Representatives. About one third of the members of the Senate will also be facing their constituents in two short years!

I will provide you with a couple of other points that I have made note of in the past but believe are important for you to consider and, perhaps, articulate for your elected representatives.

As I have noted in my appearances and in my commentaries, the DREAM Act has been concocted to take advantage of the generosity and compassion of the citizens of the United States- claiming (falsely) that this bill would simply provide young immigrants whose presence in the United States is the result of decisions made by their parents who brought these "young immigrants" with them when they ran our nation's borders.

While we consider the acronym "DREAM" I will again remind you that aliens as old as 34 would be able to participate in this program. In what parallel universe would someone who is 34 or even 30 years of age considered a "Minor?"

I have to admit that now that I am on the wrong side of 60, someone who is in their 30's does sound young to me- but to refer to people of that age as being a minor or even "young" is an absolute absurdity!

What is also amazing is that the advocates for this stealth amnesty program that would likely legalize millions of illegal aliens, even reversed their usual position of decrying the use of the term "Alien."

While the term "Alien" is certainly not the pejorative that the open borders/pro-amnesty advocates claim it is, the term does present them with a vexing problem The term "Alien" provides clarity to the debate about various aspects of the immigration issue and they certainly understand that the law, facts, commonsense and morality are all working against their goals. They know that the last thing they want is to have to debate the immigration issues on the basis of the law, the facts, commonsense or morality.

While they have claimed that there are millions of illegal aliens "hiding in the shadows," in point of fact, the illegal aliens are not hiding in the shadows but the advocates for open borders and amnesty have been attempting to hide the truth from the citizens of the United States by hiding the truth in the linguistic shadows that they have created.

This strategy of using deceptive language was first utilized by Jimmy Carter when, as President of the United States, he mandated that INS employees stop referring to illegal aliens as being, illegal aliens! We were instructed to refer to aliens who were illegally present in the United States as being "Undocumented Workers." We were told that if we, the employees of the INS, continued to use the term "illegal alien" to describe illegal aliens, extreme efforts would be taken to discipline us. Of course this did not sit well with the great majority of INS employees back then and I decided to find a way of bending the demands laid down by the INS. I took to referring to illegal aliens as being "Pre-Citizens!"

This actually caught on and I was greatly amused and, indeed, encouraged when a Border Patrol agent called my office one day seeking to get information on an individual he had arrested along the Mexican border. The alien's file was in New York City, where I worked. I answered the phone and this Border Patrol agent asked me if I could get hold of the immigration file relating to the "Pre-Citizens" he had just arrested!

It should be known that the term "Alien" is defined by the Immigration and Nationality Act as simply being any person who is not a citizen or national of the United States.

You can find this definition and the definition of all of the other essential terms at this link to Section 101 of the Immigration and Nationality Act (INA).

Virtually every other country on this planet uses similar language to describe foreign nationals who are present within their borders. I defy anyone to tell me how the term "alien" dehumanizes or insults anyone. The open borders/pro-amnesty advocates would much prefer that we refer to illegal aliens as simply being "immigrants." This term provides them with the opportunity to repeat the mantra that "We are a nation of immigrants!" By extension, they then claim that anyone who would secure our borders against the entry of anyone could then be accused of being "Anti-Immigrant!"

Here is my way of providing clarity to this argument:

The difference between an immigrant and an illegal alien is comparable to the difference between a houseguest and a burglar!

Having just provided you with the artful use of deceptive language that has all but stricken the word "alien" from the immigration debate, we suddenly find that the desire by the advocates for open borders and massive amnesty programs for illegal aliens to conjure up the image of the "American Dream" that they are now, incredibly willing to use the term alien!

As I noted in a recent commentary, the DREAM Act is an acronym for:

Development, Relief and Education for Alien Minors Act.

The attempt to see in our nation's kindness, weakness, was so strong that they were even willing to use a term that they have been adamantly eschewing for decades- "Alien." This was obviously done to equate amnesty for millions of illegal aliens with the "American Dream," a dream I might add, that has become increasingly elusive for all too many of our citizens regardless of race, religion, ethnicity or other such factors!

If our nation provides lawful status for millions of illegal aliens, it must be anticipated that they will immediately seek to petition the United States government to permit their spouses and minor children to be permitted to lawfully immigrate to the United States. This will create additional burdens on the health care systems and on our educational system. Both of these vital systems are already imploding under the weight of the demands being made upon them especially as cities and states lay off or fire teachers, police officers, fire fighters, hospital workers and other municipal workers as cities and states teeter on insolvency.

I can also tell you that in 1986 I had a front row seat to the aftermath of the Amnesty of 1986. Many newly legalized aliens did what you would expect. They went to their employers who hired them when they were illegal aliens and therefore vulnerable and easy to exploit.

These newly legalized employees demanded to be paid prevailing wages. They demanded to be paid appropriately for working overtime and working on weekends. They demanded that they be paid on the books and that safety and health issues be addressed by the employers.

Some employers simply complied by a large number did not. They fired these newly legalized employees and simply hired the next wave of illegal aliens- this is a significant part of the way that we wound up with so many illegal aliens in our country today.

It must now be anticipated that history will repeat itself. It must be anticipated that if massive numbers of illegal aliens are legalized under the auspices of an amnesty program, that unscrupulous employers will fire these aliens and simply hire more illegal aliens. Meanwhile the newly unemployed but legalized aliens will head for the unemployment line. They will seek all sorts of benefits to provide for their spouses and children for whom they would have made applications to have them join them in the United States.

How will our nation cope with this massive expense even as cities, states and, indeed, the federal government attempt to deal with the economic crisis that confronts our nation today?

How can any true leader ignore that fact that according to most estimates, one in five children in the United States is not getting proper nutrition and an estimated one in five American families are living at or below the poverty level?

It may be commonsense but it is important to remember- "Charity begins at home!"

When we board airliners and the flight attendants go through the usual talk about the use of seat belts, exits, floatation devices and oxygen masks they always admonish the passengers to not try to help passengers near them if the oxygen masks are deployed until they put their own oxygen masks on first. (You cannot help anyone if you become incapacitated!)

Today the United States of America needs to put its own oxygen mask on first! A weakened America poses a threat to the safety and security of the entire free world!

U.S. Ninth Circuit Court of Appeals Allows Illegal Alien Sex Offender To Escape Deportation, Obama's Justice Dept. Looks the Other Way


The hits just keep coming from the Leftist Ninth Circuit Court of Appeals in San Francisco and also from the U.S. Department of Justice as yet again, we see illegal aliens being given chance after chance to break the laws of this country and expose our citizens to the illicit behavior of some of them.

To be convicted of this crime under California law, the offender must be shown to have willfully exposed his private parts in a public place or in a place where there are unwilling persons. Under the law, he also must “intentionally direct attention to his genitals for sexual purposes.” For his conviction, it was necessary for the government to show that Nunez intended to direct attention to his genitals for sexual purposes; his conviction demonstrates, specifically, that he sought to sexually arouse or gratify himself or his victim.

But to the Ninth Circuit Court of Appeals based in San Francisco, there was no “moral turpitude” evident in Nunez’s crime. In an opinion by Judge Stephen Reinhardt, the deportation order was reversed. Nunez gets to stay. Reinhardt reasoned that indecent exposure is not necessarily a crime involving moral turpitude.

Judge Reinhardt downplays the seriousness and immoral nature of the crime, saying for example that what constitutes moral turpitude is “amorphous” and “could well divide residents of red states from residents of blue states.”

That’s comforting. I’m glad I don’t have to raise my children in the blue states if Judge Reinhardt is right.

So why doesn’t the Department of Justice appeal Judge Reinhardt’s opinion about indecent exposure by illegal aliens? Does Attorney General Eric Holder agree with it?

Of course, Judge Reinhardt does not have the best record when his cases are appealed to the Supreme Court. The Ninth is reversed by the Supreme Court more than any other. Even when writing for a unanimous Ninth Circuit, Judge Reinhardt may be the judge most reversed by the Supreme Court.
What kind of a statement is that from a judge on a Circuit Court? "could well divide residents of red states from residents of blue states"....???? What kind of political talk is that coming from a court?

We are seeing more and more the tendency for radical judges like this Reinhardt legislating from the bench and without a Justice Department to oversee that and squash it, it can only get worse. We see above that Reinhardt's decisions are overturned more by the Supreme Court than any other judges - so get the mutherfucker off the bench! What gives this cretin a free pass from criticism in this country?

So, this illegal alien gets to stay in America ....he gets to go around and expose his junk to school girls because Judge Reinhardt is worried about the rights of people in blue states. Is everyone cool with their 8 year old daughter being exposed to this illegal alien? And what if this scumbag decides to take his perversion to the next level? Is the rape of a 12 year old girl by this pig gonna get a free pass from Judge Reinhardt too?



Administration Shields Sexually Deviant Illegals and Supports DREAM Act


Victor Nunez is an illegal alien from Mexico. Two years after arriving in the United States, he was convicted of petty theft for shoplifting. Then, he was convicted of a much more serious crime: He exposed himself in public. But even that wasn’t enough to have him removed from the country.

After a decade of his illegal presence, the Department of Homeland Security finally brought immigration charges to remove him from the United States. Crimes of “moral turpitude,” like exposing your genitals to children, are supposed to result in certain deportation.

The Immigration Judge denied his application, and the Board of Immigration Appeals affirmed, finding that he had two convictions for “crimes involving moral turpitude,” which under the immigration laws, makes one ineligible for the green card Nunez was seeking. Nunez was on a fast track back to Mexico.

But Nunez appealed, claiming that his conviction for indecent exposure was not a crime involving moral turpitude. To be convicted of this crime under California law, the offender must be shown to have willfully exposed his private parts in a public place or in a place where there are unwilling persons. This decision demonstrates a pervasive relativism that is infecting American jurisprudence, and most of the public has no idea it is happening. The law used to be about objective right and objective wrong. The plain meaning of words governed the law.

Judge Reinhardt downplays the seriousness and immoral nature of the crime, saying for example that what constitutes moral turpitude is “amorphous” and “could well divide residents of red states from residents of blue states.”

It is true that the Obama Justice Department defended the ruling of the Immigration Judge and the Board before the Ninth Circuit, and would undoubtedly express disappointment over the decision. But if so, why has it done nothing to continue to fight the case? The Eric Holder Justice Department never even sought rehearing en banc (asking all the judges on the Ninth Circuit Court of Appeals to rehear the case), or asked the Supreme Court to take the case and reverse Judge Reinhardt.

Does the Justice Department share Judge Reinhardt’s view that an illegal immigrant’s public exposure of his genitals does not satisfy the term “moral turpitude” thereby meriting deportation?

Why didn’t it appeal? The decision is far outside of the mainstream and not consistent even with the left-of-center California Supreme Court’s interpretation of sexual crimes. In fact, it is even inconsistent with an en banc decision of the Ninth Circuit from last year, Marmolejo-Campos v. Holder. The entire Ninth Circuit held that what constitutes moral turpitude should be decided by the Board of Immigration appeals, not Judge Stephen Reinhardt.

So why doesn’t the Department of Justice appeal Judge Reinhardt’s opinion about indecent exposure by illegal aliens? Does Attorney General Eric Holder agree with it?

Of course, Judge Reinhardt does not have the best record when his cases are appealed to the Supreme Court. The Ninth is reversed by the Supreme Court more than any other. Even when writing for a unanimous Ninth Circuit, Judge Reinhardt may be the judge most reversed by the Supreme Court.

The Obama Administration claims that it is vigorously enforcing the nation’s immigration laws. The Justice Department’s unprecedented lawsuit against Arizona for trying to address illegal immigration proves otherwise. It has also been exposed through the release of internal memos that show the Obama Administration making contingency plans to implement amnesty by administrative fiat if the Congress fails to pass comprehensive immigration reform.

The Administration has already begun implementing those plans through formal new DHS directives to its career enforcement officials, ordering them not to enforce the immigration laws for what it calls “minor vehicular offenses,” if they were committed by illegal aliens who have received a high school diploma and attended two years of college. In other words, if they satisfy the amnesty requirements of a proposed law not yet passed by Congress called the DREAM Act, the DHS orders an effective amnesty.

That’s right, the Administration is enforcing a policy that has yet to pass Congress. Welcome to Legal Wonderland. Curiouser and curiouser it is.

When questioned about administrative amnesty proposals, the DHS press flunkies say “DHS will not grant deferred action or humanitarian parole to the nation's illegal immigrant population." They say they will not suspend enforcement of immigration laws. And in truth, they don’t suspend the current laws for ALL illegal aliens, only for some.

They are giving breaks to a larger and select groups of illegal aliens. This is worse than a backdoor amnesty. This is a backdoor amnesty that flaunts the rule of law. No matter your individual beliefs about immigration policy, in a nation governed by the rule of law, as passed by Congress, we should all agree the Executive Branch can’t suspend laws they simply disagree with.

The Administration has never openly stated they are suspending the enforcement of the immigration laws against sexual offenders, and in fact claims that serious criminals are its highest priority. Yet, the Justice Department is doing nothing to fight extreme pro-criminal alien decisions like this one from Judge Reinhardt.

And this case is certainly not unique among Ninth Circuit decisions rejecting government efforts to remove criminal aliens for sexual crimes. In May, the Ninth Circuit ruled in Rivera-Cuartas v. Holder, that an Arizona statue that made sexual conduct with a minor under the age of 18 years old illegal is not always “sexual abuse of a minor.” This, despite the reality that under federal law such behavior is considered an aggravated felony and almost always results in removal from the United States. The Holder Justice Department has not fought back and appealed this bad decision either.

The Obama Administration’s failure to vigorously enforce the immigration laws is becoming increasingly clear, and its failure to appeal bad decisions protecting sexual offenders like Nunez is dangerous. Department of Justice inaction will prevent many other sexual offenders from being removed from the country, at least if they live in the Ninth Circuit. DOJ inaction speaks louder than spin.

Judge Reinhardt is quoted as once saying in reference to the Supreme Court, “They can’t catch them all.” He is right about that, especially if the Justice Department doesn’t even try
